Re: [pacnog] ISP and Cloud Service Provider for sale
This is spam, nothing else than that. Any non-requested email is spam, and yes you’re selling a domain. Access to the IXP is granted in many other ways.
Let’s see if any real member of PACNOG can confirm that they asked you about that … because if that’s true, you will have done that in private.
And how you justify sending this to other NOGs? Also requested by participants? They will not confirm that, because I’m sure it is not true.
It is not a single email when you send it to all the NOGs. And in any case, spam can be a single email, if not solicited.

This is against AUP, in most of the exploders, and you should be banned.

More than that ... they tried to convince me that it was not spam in private emails and discussed that it is more efficient for everyone, etc., etc. More efficient processing thousands of spams every day, than looking with your preferred search tool for what you need? Absolutely stupid and ridiculous people.
We have a policy that we apply to all our acquisitions, and more and more people should follow it: *any* product, service, whatever, that it has been announced by *any* unsolicited message, it is automatically banned from being acquired AND we inform all our customers and suppliers about them so they also don't buy from those criminals. There are tons of suppliers which follow laws and ethics, simple! If you want to do more, we also report all those cases to the Data Protection Agency. In the case of Spain, even a single unsolicited message (never mind it is email, SMS, phone call, or even on-site cold door), can be fined up to 600.000 euros. If it is a personal email, even more, because then up to 20 million euros because EU GDPR.

There is an on-line form. You need to use a digital certificate to submit a complain to the DPA. They investigate the case and the one that sent the email need to prove that they have previous and explicit consent for each of a) get your email into their systems, databases, etc., b) send the ad.
If they don't prove that, they will get a fine, which may depend on many factors, such as if the DPA found that they didn't send only one email or only to one person or company, if they did already that previously, etc.
